Sharia is a religious legal system that is based on the divine mandates revealed in the Quram and the Sunna as has been interpreted bu the main Islamic Schools of Law, both Sunni and Shiita. In orden to understand what is at stake, distinctions between the main Islamic traditions in this ground was one of the factors that have led to an imprecise use of terminology of the Quram which refers to the Islamic divorce, that is: the Talaq. Its confusion (...) has also been reflected in the case law of the Spanish Supreme Court which regards to the effects of Talaq under the Spanish Civil Law. Bilateral Accord concluded betwen the Spanish Goverment and the Islamic Religious Comunities of Spain has not regulated the requirements of the recognition of the islamic divorce in our legal system. Nevertheless, whether repudiation has been made under the Civil Law of a Muslim State, it could be recognized in Sapin under the rules of procedure of the International Private Law. The main purpose of such recognition is to guarantee the basic civil rights and liberties of the woman who has been repudiated. (shrink)

Intercultural dialogues and exchanges taking place in this (...) context are born of feelings and emotions as intense and enriching as those that take place in real life, insofar as they emerge from the essence of personal identity, of one’s own ideology or conscience; And are governed, in most cases, by the regime of freedom that characterizes the digital culture, to act according to their own ideas, convictions or beliefs. The progress the Internet has experienced in recent years has brought about huge changes and social transformation in all aspects of our lives. One such aspect greatly impacted has been our health, where we can talk about the existence of an ‘Internet of Medical Things’. Amid this digital drift, we have seen the development of pharmaceutical drugs that provide information to patients and their attending healthcare teams concerning medication, doses ingested, and time of ingestion. These are digital pills or digital (...) medication. In this context, the purpose of my paper is to analyze the ethical and legal impact of digital medication, further analyzing the implications concerning the right of service users to make decisions over their own health in Spain. Los usuarios de los servicios sanitarios que reclaman el ejercicio efectivo de las diferentes manifestaciones de su libertad religiosa cuando se hallan internados en instituciones sanitarias públicas. Me refiero a solicitudes que deben ser atendidas por las autoridades pertinentes, en orden a promover, en condiciones de igualdad real y efectiva, el pleno disfrute de aquella libertad religiosa en este ámbito. La mujer todavía tiene numerosas barreras para poder acceder al Deporte (Pérez-Ugena, 2020). Esto se debe, tal y como indica Monforte y Úbeda-Colomer (2019) a que los estereotipos de género siguen existiendo en nuestra sociedad. El objetivo de estudio fue analizar los estereotipos de género en la Actividad Física y el Deporte en 51 adolescentes, utilizando para ello variables sociodemográficas y el instrumento de CEGAFD (Granda et al., 2018). Después de transcurridos los años de violencia política en los años 80’s e inicios de los 90’s, Perú se vio envuelto en cambios estructurales que permitieran una reconstrucción nacional de la sociedad peruana. Durante este periodo, los diferentes procesos migratorios, los cambios en la política económica interna, las reformas políticas y educativas condicionaron a los peruanos y a las futuras generaciones bajo un modelo urbano de desarrollo basado en el consumo, la individualidad y modernidad. Un modelo de desarrollo político, educativo (...) y cultural que no incluya la violencia y la memoria como parte de la identidad y quehacer nacional. El presente texto propone una mirada crítica a los orígenes y consecuencias de la violencia política en nuestro país, analizando la relación entre los actores implicados, los proyectos ideológicos y la lucha por los derechos humanos. Nowadays, most loan transactions are contracted by using the exponential discounting as the underlying standard economic model to value this type of financial operations. In a framework of absence of fees to be paid by the borrower, the interest rate of the exponential discount function is, moreover, the true interest rate of the operation. Nevertheless, there exist a set of circumstances which make this identity false. Among others, these characteristics are: the use of linear discount as the underlying discount function, (...) splitting time when using a nominal interest rate, and the existence of fees in a loan at 0% interest rate. Type 2 diabetes has been considered a public health threat due to its growing prevalence, particularly in the older population. It is important to know the effects of psychosocial stress and its potential consequences for some basic cognitive processes that are important in daily life. Currently, there is very little information about how people with T2D face acute psychosocial stressors, and even less about how their response affects working memory, which is essential for their functionality and independence. Our aim was (...) to characterize the response to an acute laboratory psychosocial stressor and its effects on WM in older people with T2D. Fifty participants with T2D from 52 to 77 years old were randomly assigned to a stress or control condition. Mood and physiological responses to tasks were measured. In addition, participants completed a WM test before and after the stress or control task. Our results showed that the TSST elicited higher negative affect and greater C and sAA responses than the control task. No significant differences in WM were observed depending on the exposure to stress or the control task. Finally, participants who showed higher C and sAA responses to the stressor had lower WM performance. Our results indicate that medically treated older adults with T2D show clear, typical mood and physiological responses to an acute psychosocial stressor. Finally, the lack of acute psychosocial stress effects on WM suggests that it could be related to aging and not to this disease, at least when T2D is adequately treated. (shrink)

Este artículo propone una exploración de los textos compilados en Marginales de la Vida (1963), título publicado por el salvadoreño Arturo Ambrogi en 1912, a partir de los vínculos que se establecen en ellos entre la influencia de la estética modernista y el oficio periodístico practicado por el autor. Los objetivos centrales son aproximarse a la producción literaria de Arturo Ambrogi mediante un análisis de las tensiones generadas al momento de ubicar parte de su escritura dentro de la literatura salvadoreña, (...) centroamericana y latinoamericana de principios del siglo XX, a la vez que se postula la posible existencia de un híbrido literario que rehuyó en gran medida de los puntos de vista seguidos por otros autores contemporáneos de la región durante la época en estudio. This essay surveys the present position of postmodernism with respect to the effect of its ideas upon historiography. For this purpose it looks at a number of writings by historians that have been a response to postmodernism including the recently published collection of articles, The Postmodern History Reader. The essay argues that, in contrast to scholars in the field of literary studies, the American historical profession has been much more resistant to postmodernist doctrines and that the latters' influence upon the (...) thinking and practice of historians is not only fading but increasingly destined to fade. The essay also presents a critical discussion of the current philosophy of postmodernism in its bearing upon historiography, directed chiefly against its claim that the world has undergone an epochal transition from the modern to a postmodern age; its theory of language and linguistic idealism; its opposition to historical realism and denial of the actuality of the past as a possible object of reference; and its theory of historical narrative as unconstrained fictional construction. This discussion includes a consideration of the work of postmodernist thinkers such as J.-F. Lyotard, of the recent books by David Roberts and Robert F. Berkhofer, Jr. which espouse a postmodernist theory of history, and of the narrativist theory of Hayden White. The essay also notes some of the reasons for postmodernism's appeal; and while it does not deny that postmodernist philosophy may have served a useful purpose in provoking historians to be more self-critical and aware of their presuppositions and procedures, it maintains that its skeptical and politicized view of historical inquiry is deeply mistaken, out of accord with the way historians themselves think about their work, and incapable of providing an understanding of historiography as a form of thought engaged in the attainment of knowledge and understanding of the human past. En este encuentro convergen monstruos reales y ficticios -aunque nos cueste diferenciarlos-, así como las neurosis del siglo XXI y las leyendas del siglo XIX, que aliviadas unas por el psicoanálisis y alimentadas otras, por los primeros experimentos de “ingeniería genética”, consiguen sembrarnos una interrogante sobre la (in)distinción de lo real en nuestro entorno. We argue that the later Wittgenstein’s philosophy of language and mathematics, substantially focused on rule-following, is relevant to understand and improve on the Artificial Intelligence (AI) alignment problem: his discussions on the categories that influence alignment between humans can inform about the categories that should be controlled to improve on the alignment problem when creating large data sets to be used by supervised and unsupervised learning algorithms, as well as when introducing hard coded guardrails for AI models. We cast these (...) considerations in a model of human–human and human–machine alignment and sketch basic alignment strategies based on these categories and further reflections on rule-following like the notion of meaning as use. To sustain the validity of these considerations, we also show that successful techniques employed by AI safety researchers to better align new AI systems with our human goals are congruent with the stipulations that we derive from the later Wittgenstein’s philosophy. However, their application may benefit from the added specificities and stipulations of our framework: it extends on the current efforts and provides further, specific AI alignment techniques. Thus, we argue that the categories of the model and the core alignment strategies presented in this work can inform further AI alignment techniques. (shrink)

Wil Waluchow’s notion of Community’s Constitutional Morality (CCM) was developed as a tool for the identification of moral norms and considered judgments that are in some way tied to a community’s constitutional law and practices. In this paper I first argue that even though the tool was conceived under a state-based paradigm, it also works on a global scale. Then, I show how by relying on this tool we can achieve two important and clearly differentiable goals. The first goal relates (...) to efforts regarding the construction of global theories of justice. By using Waluchow’s CCM we can overcome what I call the problem of adjudication among differentexisting moral intuitions. That is, the need to choose between different and competing fundamental moral commitments that ought to guide our moral deliberations. Instead, by using CCM, we can identify Embodied Moral Intuitions that hold an epistemic advantage over Personal Moral Intuitions, which are commonly used to ground normative projects. The second goal relates to contemporary efforts to decolonize our perspectives about justice, domestic and global. By relying on Waluchow’s notion of CCM, the reality that Indigenous knowledge, despite it not having been properly acknowledged in most philosophical academic debates, is already a part of our debates about global justice becomes undeniable and a call for action to further expand our understanding of global political morality. Resumen: El discurso de la economía ha transitado por una tensión entre pertenecer a una Ciencia Social y presentar rasgos prototípicos de una Ciencia Básica. Ahora bien, evidenciar esta hibridez desafía a los investigadores del lenguaje, sobre todo si estos textos son parte de la formación de un economista. Particularmente, el Informe de Política Monetaria no ha sido estudiado desde el punto de vista lingüístico, por lo que se busca observar, en un corpus de 45 textos, si el género IPOM (...) evidencia dicha tensión discursiva de la disciplina. Para lograr ese objetivo, se ha optado por una metodología basada en dos dimensiones: Contexto de Producción y Organización Retórico-Funcional. Tras el análisis, los hallazgos del corpus IPOM-2013 integradamente muestran que el género IPOM efectivamente evidencia dicha tensión con rasgos más características de la CB como es el uso de recursos matemáticos y, por otro lado, rasgos de la CS, asociados a la modalización del discurso en su macromovida central.: The discourse of economy has gone by a constant tension between belonging to a Social Science and present prototypical features of a Basic Science. However, evidence this hybridity poses a challenge for researchers of language, especially if these texts are part of the training of an economist. In particular, the Monetary Policy Report has not been studied from the linguistic point of view. In this context, this research search to answer the question whether the gender IPOM evidences such discursive tension of the discipline. To achieve this objective, it has opted for a methodology based on 2 dimensions: Production Context and Rhetorical-Functional Organization. After the analysis, the findings Integrally shows that the IPOM genre effectively demonstrates this tension with features more characteristic of the BS such as the use of mathematical resources and, on the other hand, SC traits, mainly associated to the modalization of the discourse in its central macromove. Hidden cluster problems can manifest when broad ethnic categories are used as proxies for cultural traits, especially when traits are assumed to encode cultural distances between groups. We suggest a granular understanding of cultural trait distributions within and between ethnic categories is fundamental to the interpretation of heritability estimates as well as general behavioral outcomes.

Are intelligent machines really intelligent? Is the underlying philosoph- ical concept of intelligence satisfactory for describing how the present systems work? Is understanding a necessary and sufficient condition for intelligence? If a machine could understand, should we attribute subjectivity to it? This paper addresses the problem of deciding whether the so-called ”intelligent machines” are capable of understanding, instead of merely processing signs. It deals with the relationship between syntax and semantics. The main thesis concerns the inevitability of semantics for any (...) discussion about the possibility of building conscious machines, condensed into the following two tenets: ”If a machine is capable of understanding (in the strong sense), then it must be capable of combining rules and intuitions”; “If semantics cannot be reduced to syntax, then a machine cannot understand.” Our conclusion states that it is not necessary to attribute understanding to a machine in order to explain its exhibited “intelligent” behavior; a merely syntactic and mechanistic approach to intelligence as a task-solving tool suffices to justify the range of operations that it can display in the current state of technological development. Rodger et al have interestingly argued that xenotransplantation should, if possible, entail the use of genetic pain disenhancement to prevent otherwise unavoidable pain in ‘donor’ animals.1 Their argument relies on the empirical assumption that xenotransplantation offers a realistic solution to organ shortage, and that, due to the recent clinical developments and the lack of human donors, it will thus continue for the foreseeable future. We argue below that other options should be prioritised over xenotransplantation, and that so-called ‘non-sentientist’ harms are (...) undervalued in discussions on disenhancement. We do not challenge the empirical claim made by the authors. That is, xenotransplantation research might continue for the foreseeable future since organ demand is increasing. However, we disagree with the priority given to xenotransplantation over other solutions that are more morally desirable. We argue that, if we comply with the 3R principles (Replacement, Reduction, and Refinement of the use of animals in research) and follow a minimal welfarist reasoning (to which the authors seem to adhere), then (1) the principle of replacement demands the use of non-animal alternatives if possible and (2) there are alternative solutions that lead to morally better consequences. Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. Communicative acts of some women are perpetuating the dominance that DTM have over both women and OTM. Some women use language in a disdainful manner to reprimand oppressed men’s behavior in daily life situations, the same behavior that such women would not reproach to DTM. But NAM are reacting to this. This article analyzes the communicative acts employed in all these situations, both those produced by women and DTM, as well as NAM’s communicative acts in response to those offenses. Data (...) was collected using communicative daily life stories of give women and three men with diverse profiles and different levels of participation in women’s and men’s movements. Findings highlight, from the transformative dimension of the communicative methodology, that the use of language of desire in NAM’s reactions is effective not only to make justice with men who have never executed violence on women, but also to undermine the attractiveness of both DTM’s behavior and the comments of some women on such behavior. These findings complement previous research on preventive socialization of gender violence by broadening scientific knowledge on NAM’s communicative acts that prevent and eradicate gender-based violence. Further research ought to broaden the evidence of how some women who defend feminist values sometimes do not support and even tease or reprimand men who practice these values; moreover, an important line could analyze the way people talk about men with NAM attitudes to hold back reprimands in comparison to how people talk about men who follow a DTM model. ​This paper examines the life and work of the Novohispanic philosopher Sor Juana Inés de la Cruz, who used a great deal of irony to respond to what, we argue, were gender-based microaggressions in 17th century New Spain. The case of Sor Juana is particularly interesting not only because it suggests that microaggressions are not the product of our time, as has been suggested in the literature, but also because it reveals some of the advantages as well as limitations of (...) using irony when one is subject to microaggression. The case of Sor Juana also provides insights regarding the difficulties of using irony to address microaggressions that take place in the classroom. (shrink)

El texto presenta una articulación de las reflexiones de Rosa Luxemburg en torno a la tarea de ilustración de las masas (Aufklärungsarbeit) y de las de Bertolt Brecht a propósito del efecto de distanciamiento (Verfremdungseffekt) en su propuesta de teatro épico. La contribución pone el énfasis en tres ejes: (1) el lugar central que ocupa el pensamiento crítico de las masas; (2) el tipo de vínculo entre individuo y sociedad que se deduce de sus propuestas y (3) la no previsibilidad (...) de los efectos de tales procesos. El análisis de sus textos a la luz de estas tres dimensiones pone sobre la mesa la continuidad entre sus ideas y la relevancia que ambas firmas otorgan a los procesos históricos de democratización y de formación de una ciudadanía políticamente activa; dos aspectos que son, en su obra, a la vez el ímpetu y el horizonte de la revolución socialista. Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. In Switzerland, the importance of transparency in animal experimentation is emphasized by the Swiss Federal Council, recognizing the public’s great interest in this matter. Federal reporting on animal experimentation indicates a total of 585,991 animals used in experiments in Switzerland in 2022. By Swiss law, the report enables the public to learn about many aspects such as the species and degree of suffering experienced by the animals, but some information of interest to the public is missing, such as the fate (...) of the animals at the end of the experiment (e.g., euthanized, rehomed in a private home, reused in another experiment). When it comes to animals bred in facilities but not used in experiments, further information of interest is not required to be made public according to Swiss law, for example, the number and fate of “surplus” animals (i.e., animals bred but not used in experiments for a variety of reasons such as not carrying the phenotypical properties needed). Considering that the Swiss government has a duty to provide a full accounting of animal experimentation conducted on the public’s behalf, further relevant information should be disclosed. While efforts toward transparency, such as the STAAR Agreement, have been made in the scientific community, these mostly reflect the legal requirements already in force. If Switzerland is to move toward more transparency in public information on animal experimentation, an update of the legal requirements is needed. In this article, we give recommendations for Swiss law to move toward more transparency in public information on seven aspects: (1) the fate of the animals at the end of the experiment; (2) the sources of funding for animal experimentation; (3) the harm-benefit analysis performed by researchers and ethics committees to justify an experiment using animals; (4) the number of breeding/surplus animals; (5) the fate of breeding/surplus animals; (6) the harms experienced by animals in facilities; and (7) the funding of animal facilities. Frente a la imagen de un Vico ajeno a las exigencias del rigor metódico, este trabajo se propone plantear: a) Que la preocupación por el problema del método es una constante en el pesamiento de Vico. b) Que su aportación debe considerarse especialmente relevante en lo que atañe a los actuales empeños rehabilitadores de la racionalidad práctica y, en particular, para las más recientes teorias de la argumentación jurídica. c) Que, no obstante lo anterior, la actitud metódico jurídica de Vico (...) no puede ser calificada de meramente "retórica", más bien, entraña un intento de proyectar principios de justificación racional a los tópicos argumentativos del Derecho; o a propiciar un esfuerzo integrador de los topoi retóricos de las controversias jurídicas con las exigencias justificatorias de la razón práctica. Para explicitar este enfoque se procederá a abordar, por aproximación sucesiva, tres cuestiones: 1ª) Los aspectos básicos del actual debate sobre la racionalidad juridica y la teoría de la argumentación en el Derecho. 2ª) La apelación a Vico como punto de partida del nuevo interés por la revalorización de la tópica jurídica. 3ª) El significado de la argumentación en el "interior" de la reflexión metódica viquiana y en sus proyecciones "externas" al presente.Contrarily to the images purporting Vico as a thinker who paid little attention to methodological rigor, this paper aims to show: a) that there is a through concern along the Vichian thought with problems related with methodology; b) that Vico’s philosophical contributions should be acknowledged particularly relevant in those subjects connected both with practical rationality and recent theories about legal reasonings; c) that Vico’s methodological and legal approach can, nonetheless, hardly be labelled merely as "rhetoric", rather it entails a serious attempt to cast rational justifying pnnciples onto the topic related with legal reasonings. In order to accomplish the above claims, three related questions should be addressed: 1) the basic elements underlying the recent discussion on legal rationality and theories about patterns of reasonings in law; 2) the claim that Vico is to be regarded as a starting point in the new assessment of legal topic; 3) the meaning of the arguments inside the limits of the Vichian methodological reflections and the extemal connections they still keep with contemporary discussions. El presente artículo recoge un texto inédito hasta la fecha del filósofo español Manuel Sacristán Sacristán (1925-1985) en torno al libro El futuro del Partido Comunista Francés, un ensayo de Waldeck Rochet (1969), entonces secretario general del PCF. En el mismo pueden observarse motivaciones políticas de Sacristán características de su tiempo que parecen prefigurar parte de la caracterización que más adelante realizará en torno al eurocomunismo, donde la firme defensa de los valores democráticos en el marxismo no es incompatible con (...) críticas a determinadas involuciones político-institucionales en el campo de los partidos comunistas europeos de la época. McLeod's Conscience in Reproductive Health Care offers a number of valuable contributions to the literature, both within and beyond reproductive care. In this commentary, I begin by discussing two potential applications of her argument that healthcare professionals—specifically, those "who are charged with gatekeeping access to healthcare services" —have a fiduciary duty of loyalty to prioritize the interests of their patients over their own. Then, I turn to a couple of concerns one might raise about extending this fiduciary duty to pharmacists (...) who function as gatekeepers of reproductive services. Las directrices anticipadas aún no se encuentran legisladas en todos los estados de la República mexicana. En algunos de los estados en los que sí se encuentran legisladas, se prohíbe expresamente su validez durante el periodo de gestación. Lo anterior representa dilemas bioéticos y jurídicos importantes, los cuales revisamos para esclarecer las diversas interrogantes que surgen en materia de la protección tanto del bebé como de la madre gestante. Concluimos que existe una necesidad de desarrollar una ley federal que homologue (...) las directrices anticipadas, garantizando una muerte digna a todos los mexicanos, y que establezca que en caso de encontrarse en periodo de gestación, se busque asesoría por un comité de bioética que apoye a determinar en cada caso particular, las condiciones que favorezcan el desarrollo y supervivencia del bebé, siempre que sea posible, sin recurrir a tratamientos y/o medidas extraordinarias que pongan el riesgo la muerte digna y libre de sufrimiento de la madre. Este trabajo pretende justificar que, aun cuando es cierto que hay diferencias entre la filosofía aristotélica y la schmittiana, existe un punto de conexión entre ambos en lo que se refiere a la prudencia. En particular, se pretende demostrar que en la descripción que hace Schmitt de la función del juez en Ley y Juicio y en Sobre los tres modos de pensar la ciencia jurídica están presentes ideas propias de la filosofía práctica del estagirita. This work aims to justify (...) that, although it is true that there are differences between Aristotelian and Schmittian philosophy, there is a point of connection between both in what refers to prudence. In particular, we intend to demonstrate that in Schmitt's description of the role of the judge in Law and Judgment and On the three types of juristic thought ideas of the practical philosophy of the Stagirite are present. brazil has gone through a long process of colonization that still leaves violent marks in the ways of relating to quilombola communities, producing the devaluation of their cultures and knowledge. Through colonization, the lives of quilombola children and young people have become invisible in the face of scientific knowledge that uses European authors as a reference and the urban middle classes as a model. In this text, we present the results of an interventional research carried out between 2017 and 2019, (...) with about 30 children and young people living in a quilombola community in Cafuringa, in Campos dos Goytacazes-RJ. We seek to understand how the experiences of childhood and youth are constituted from the relationships that children and young people establish with the territory, their uses and appropriations, and the modes of subjectification in the face of conflicts experienced in the community. Children take ownership of the territory through collective games held outdoors, in which they explore community spaces, and interact with the land, animals, plants and trees. For these children, these spaces can be "bewitched", "haunted", "sacred", and while fascinating, also generate fear. These ways of relating to the territory are in conflict with the agricultural produce and horse breeding farms, which consider the land as a business, and animals and plants as goods. The children's estrangement in encountering of the electric fence placed by the farm, which symbolizes the private use of the land, social inequalities, and the racial discrimination experienced in their daily lives, leads us to question the project of the overall “civilizing” project built into modernity.
